Terms of use

CONDITIONS OF USE OF THE PLATFORM:

GPI Mexico provides a personalized subscription service that allows our members to access plans of all kinds in CDMX, ("the GPI Mexico platform") through the internet on computers and other devices connected to the Internet ("Ready devices GPI Mexico”).

These Terms of Use govern your use of our service. As used in these Terms of Use, the phrases “the GPI México service”, “our service” or “the service” refer to the personalized service provided by GPI México to discover and access the content of GPI México, including all the features and functionality, recommendations and reviews, our websites and user interfaces, and all content and software associated with our service.

  1. Subscription

    1.1. Your GPI Mexico subscription will continue until you cancel it. To use the GPI Mexico service, you must have Internet access and a GPI Mexico ready device, and provide one or more Payment Methods. “Payment Method” means a current, valid and accepted payment method, which may be updated from time to time and which supports payments through third parties. Unless you cancel your subscription prior to your billing date, you authorize us to charge your Payment Method for the next billing cycle's subscription (see “Cancellation” below).

    1.2. We may offer various subscription plans, including subscriptions offered through third parties in conjunction with the provision of their own products and services. We are not responsible for the products and services provided by such third parties. Certain subscriptions have different terms and limitations that are made clear in the subscription agreement or other communications. Specific information about your GPI Mexico subscription can be found by visiting the GPI-mx.com website and clicking on the “Account” link, available at the top of the pages under your profile name.

  2. Promotional offers. From time to time, we may make special offers on promotions, plans or subscriptions (“Offers”). GPI México determines the requirements to access the Offer in its sole discretion, and we reserve the right to revoke an Offer and suspend your account if we determine that you are not eligible. We may use information such as device ID, payment method, or account email address used with an existing or recent GPI Mexico subscription to determine Offer eligibility. Eligibility requirements and other limitations and conditions will be disclosed to you when you sign up for the Offer or in other communications made available to you.

  3. Billing and cancellation

    3.1. Billing cycle. Subscription charges for the GPI Mexico service and any other charges you incur in connection with your use of the GPI Mexico service, such as taxes and possible transaction fees, will be charged to your Payment Method on the date of payment. specific payment indicated on the “Account” page. The length of your billing cycle will depend on the type of subscription you selected when subscribing to the service. In certain cases, your payment date may change, for example, if your Payment Method could not be charged successfully, when you change your subscription plan, or if your paid subscription started on a day that is not included in a certain date. month. We may authorize your Payment Method prior to subscription or service-related billing through various methods, including authorizing it for approximately one month of service from your registration.

    3.2. Payment Methods. To use the GPI Mexico service you must provide one or more Payment Methods. You authorize us to charge your subscription amount to any Payment Method associated with your account in the event of the rejection or unavailability of your primary Payment Method. Any pending charges will be your responsibility. If payment cannot be made successfully, due to due date, insufficient funds, or other reason, and you do not cancel your account, we may suspend your access to the service until we obtain a valid Payment Method. For some Payment Methods, the issuer may charge you certain fees, such as foreign transaction fees or other fees related to processing your Payment Method. Local taxes vary depending on the Payment Method used. Check with the service provider of your Payment Method for information.

    3.3. Updating your Payment Methods. You can update your Payment Method on the “Account” page. We may also update your Payment Method using information provided by the applicable payment service provider. Following any update, you authorize us to charge the applicable Payment Method(s).

    3.4. Cancellation. You can cancel your GPI Mexico subscription at any time, and you will continue to have access to the service until the end of your billing period. To the extent permitted by applicable law, payments are non-refundable and no refunds or credits will be given for partially used subscription periods or for unused GPI Mexico content. To cancel, visit the “Account” page and follow the instructions. If you cancel your subscription, your account will be automatically closed at the end of your current billing period. To see when your account will close, click on Billing Information at the Account page.

    3.5. Changes in price and subscription plans. We may change our subscription plans and the price of our service from time to time. However, any changes in prices or subscription plans will be applied no earlier than 30 days after notification.

 

  1. GPI Mexico Service

    4.1. You must be at least 18 years of age to become a member of the GPI Mexico service. Minors may use the service with adult supervision.

    4.2. The GPI Mexico service and all content accessed on it are for personal, non-commercial use only and should not be shared with others. During the GPI México subscription, we grant you a limited, non-exclusive and non-transferable right to access the GPI México service and content. Beyond this, no other right, title or interest will be transferred to you. You agree that you will not use the service for public presentations.

    4.3. You may access GPI Mexico content primarily in the country where you established your account and only in geographic locations where we offer our service and where such content is licensed. The content that may be available may vary by geographic location and changes periodically.

    4.4. GPI Mexico continually updates the service, including its content catalog. In addition, we regularly test various aspects of our service, such as our websites, user interfaces, promotional features, and the availability of GPI Mexico content.

    4.5. You agree to use the GPI Mexico service, including all features and functionality associated with it, in accordance with all applicable laws, rules and regulations, or any other restrictions on the use of the service or its contents. You agree not to archive, reproduce, distribute, modify, display, perform, publish, license, create derivative works based on the service, or offer for sale, or use (except as expressly authorized in these Terms of Use) content and information contained in or obtained through the GPI Mexico service. You also agree: not to circumvent, remove, alter, disable, interfere with, or circumvent the content protections of the GPI Mexico service; not use any robot, spider, scraper or other automated way to access the GPI Mexico service; or decompile, reverse engineer, disassemble the software or other product or process accessed through the GPI Mexico service; not to introduce in any way a code or product or manipulate the content of the GPI Mexico service; or use any method of analysis, extraction or data collection. In addition, you agree not to upload, post, email or otherwise transmit any material designed to interrupt, destroy or limit the functionality of the software, hardware or telecommunications equipment associated with the GPI Mexico service, including material that contains software viruses or any other code, files or programs. We may terminate or restrict your use of our service if you violate these Terms of Use or are involved in illegal or fraudulent use of the service.

    4.6. GPI Mexico software is developed by Tierra Digital or at the request of GPI Mexico, and may only be used personally. This software may vary by device and media, and functionality and features may also vary from device to device. You acknowledge that use of the Service may require third party software that is subject to third party licenses. You agree that you may automatically receive updated versions of the GPI Mexico software and related third-party software.

  2. Passwords and account access. The member who created the GPI Mexico account and to whom charges are billed through their Payment Method (the “Account Owner”) is responsible for any activity that occurs on the GPI Mexico account. To maintain control over the account and prevent anyone from accessing the account (which would include information about the account's viewing history), the Account Owner should maintain control over the GPI Mexico-ready devices used to access the account. to the service and not disclose the password or the Payment Method information associated with the account to anyone. It is your responsibility to update and maintain the accuracy of the personal information you provide to us regarding your account. We may decide to terminate your account or suspend it to protect you, GPI Mexico or our partners from identity theft or other fraudulent activity.

  3. Exclusion of Warranties and Limitations of Liability. The GPI Mexico service is offered "as it is";, without warranty or condition. In particular, our service is not declared to be uninterrupted or error-free. You waive all special, indirect and consequential damages against us. These terms will not limit any non-waivable warranties or mandatory consumer protection rights that may apply to you.

  4. Class Action Waiver. TO THE EXTENT PERMITTED BY APPLICABLE LAW, YOU AND GPI MÉXICO AGREE THAT YOU MAY EACH BRING CLAIMS AGAINST THE OTHER ONLY ON YOUR OWN BEHALF, AND NOT AS A PLAINTIFF OR PART OF A CLASS IN A CLASS OR REPRESENTATIVE ACTION. In addition, if permitted by applicable law, unless both you and GPI Mexico agree otherwise, the court may not join the causes of more than one person with your case or otherwise preside over any representative or class action. .

  5. miscellaneous provisions

    8.1. Current law. These Terms of Use will be governed by and construed in accordance with the laws of Mexico.

    8.2. Unsolicited material. GPI México does not accept unsolicited materials or ideas for its content, and is not responsible for the similarity between the contents or in any medium with the materials or ideas provided to GPI México.

    8.3. Customer service. If you need more information about our service and its features, or if you need assistance with your account, please visit the GPI Mexico Help Center, which you can access through the gpi-mx.com site In the event of a dispute between these Terms of Use and information provided by Customer Service or other sections of our website, these Terms of Use will govern any differences.

    8.4. Continuation of validity. If any of the provisions of these Terms of Use is declared null, illegal or unenforceable, the validity, legality and application of the remaining provisions will continue in full force.

    8.5. Changes to the Terms of Use and Assignment. GPI Mexico may change these Terms of Use from time to time. We will let you know at least 30 days in advance if these changes apply to you. We may assign or transfer our agreement with you, including our associated rights and obligations at any time, and you agree to cooperate with us in connection with such assignment or transfer.

    8.6. Electronic communications. We will send your account information (for example, payment authorizations, invoices, password or Payment Method changes, confirmation messages, notices) electronically only, for example, by email to the email address provided during registration.
